Legal Question in Real Estate Law in Minnesota

Squatters Rights

We purchased a home 5 years ago. Our land backs up to some woods. The previous owners (of 20 years) used part of this track. We have continued to upgrade the property - clearing and landscaping. We now find out that the property is owned by someone. I have heard about Squatters Rights and that if used and kept up for 7 years then the property becomes yours. Is this true? If so, how does one go about making it the 5 years we have owned our house.

Thanks

Re: Squatters Rights

The typical time needed is 15 years of continuous, open and adverse use or occupancy. These cases depend on individual facts. You need a lawyer to review the facts in detail and then discuss whether some settlement of the issue can be reached or whether it is appropriate to have your claim confirmed by a court in a quiet-title action.
