Legal Question in Real Estate Law in Minnesota
Temp. Grade Easement
The County is Black topping our road. We recv'd a form
by our local Law firm to Sign & have Notarized. Basically
stating that the county wants to go 10 feet onto our
Prop. so they can straighten our road for Black topping-
Our house is right on a curve of the new road. Would we
be compensated financially for this or do we have no re-course and just sign & Notarized. ( Its called a Temp. Grade easement )
Thanks

Re: Temp. Grade Easement
I really hate to say you have no recourse, because there is probably a way to object to what you are being requested to do. On the other hand, it sounds as if this is temporary, just for the purpose of allowing the equipment to come on your property for this one occasion.
The city's point of view on this most likely is that it will increase your property value, not diminish it. They could be right. It would still be a good idea, however, to show this to an attorney in your community and consult concerning your options.
I tell all my clients: Don't sign anything until you have shown it to me.
Good luck.
