Legal Question in Real Estate Law in Minnesota
Unsatisfied liens of record against our property
A Minnesota county abstract & title office has our property listed with 2 unsatisfied liens against it. One lien is our current mortgage, the other is a lien from 1975 executed by the previous owners. In 1977 at our house closing & in our documentation and records on the purchase of the house, this 1975 lien was paid at the time of the closing. Apparently, the paperwork was never filed with the county & is still on record. I have attempted to locate our original Mortgage company and the company we had title insurance with. I cannot find these businesses anywhere. I have also attempted to located the mortgage company that has the lien from 1975, and cannot find this company either. I have attempted to talk to the county regarding this matter and how to satisfy the lien, but they tell me I am asking for legal advice, which they cannot give me. How do I go about ''satisfying'' the 1975 lien on the county records?

Re: Unsatisfied liens of record against our property
Ultimately you may need to hire an attorney to do a quiet title action.
First, however, I would try calling the MN Department of Commerce, banking division. They regulate mortgage companies and banks and I believe real estate brokers. They can probably help you track down the sucessors to the companies in question. Try calling them at 651-296-2594. That's the number I have in my data base. If that number is old and doesn't work, call general information for the state of MN.
Another good resource is the MN Secretary of State - 651-296-2803.
Good luck.
If that doesn't work, I know lots of other tricks. My number is 952-544-6356.
