Legal Question in Real Estate Law in Minnesota

Warranty Deed

On December 12, 1999, my former husband signed a Marital Lein giving me 30% of resale value of our home when sold. But due to foreclosure proceedings and a federal lien, we had to sell the home to his parents on December 13, 1999. I signed a Warranty Deed at closing. Now they are selling the home. Did I give up all my rights when I signed the Warranty Deed?

Re: Warranty Deed

I expect you did - at least your right to be paid out of the proceeds of the sale of that home. Depending on how your divorce decree is drafted, you could still have a right to be paid eventually by your X.

You should probably consult an attorney and have your decree and all of the related paperwork reviewed; and after this don't sign anything without having it looked at first by a lawyer.

Good luck.
