I paid an out of state CPA to do my tax return but only received my federal refund. I can no longer get in touch with him. Should i sue him or whats the best approach? Can i obtain it by contacting a state official?

I not sure whether you live in Minnesota or Mississippi. Both states, however, have governing boards (http://www.boa.state.mn.us/Licensing/ and http://www.msbpa.ms.gov/). Contacting the appropriate board should be your next step.
