Legal Question in Traffic Law in Minnesota

I have been charged with my 4th DWI 2yrs ago and have been on probation for one yr so far. My license is IPS and I am not suppose to drive, well do to an emergency, I did and got caught. I went to jail for the night and they impounded my boyfriends car. My probation officer is not violating me. I am concerned what the judge will do, does anyone have any input?

If your probation officer is not violating you, you should not have any probation violation hearing regarding the prior DWI. You will likely face a Gross Misdemeanor Driving without a license - IPS. MSA 171.24(5)(a). which is punishable by up to a year in jail or $3000.

Depending on the situation you may be looking at anything from time in jail to a few days of community service, all the way down to simply additional probation. You may even be able to get the case dismissed under the right circumstances. It's important that you contact an attorney to discuss the specifics of your case.
