Technically the charges can be dropped, but it is very unlikely that is what would happen. If you were charged with a crime, I would strongly suggest that you hire an attorney to help you with your case.

The mistake is probably not going to get you off the hook. You could use it to attack the credibility of the officer, but it is not a get out of "jail free card."
