Driving after Cancellation
What are the sentencing guidelines for driving after cancellation, when one has 3 prior DUI convictions in the last 10 years, the most recent being 3rd degree, refusal to test, about 3 years ago? Subject has extensive criminal record for theft/forgery, etc.; however, is not currently on parole/probation. Subject was pulled over in a work truck by State Patrol and DOT in order to determine if load was within limits. No aggravating factors persuant to arrest.

There is no presumptive sentemnce. As such, it is a misdemeanor and, if convicted, the Judge may impose all or part of a 90 day sentence and a $1000 fine.
