Legal Question in Traffic Law in Minnesota

Handicap Parking Laws

When there is a handicap parking sign, what is the rule/law as to where the sign should be located when parking with no parking meter on a street. IE: In front of the car, by the door, rear of car, etc..?

Re: Handicap Parking Laws

There are two sources of regulations for such things. The first is a book of specificatins which is kept by the state highway engineer - who can be found in the Transportation Department I believe - and the other is the ordinances of the city where the event takes place.

There are lots of ifs, buts and maybes, BUT last time a checked a sign such as you describe had to be set back from the curb at least three feet, and the distance from the bottom of the sign to the pavement was supposed to be six feet.

I've had lots of clients out measuring signs. Once I can find a violation of the regulations, there is a 1966 Minnesota case which says you can't be charged with disobeying a traffic control device which is substantially not in compliance. That word "substantially" leaves the judges some wiggle room, and not all judges buy such arguments. I have won a couple cases on this basis, however.
