Legal Question in Traffic Law in Minnesota

No insurance violation

I have 2 no appearances for 'no insurance vioations' in MN.Can I hire an attorney to make these appearances for me or do I have to travel back to MN? I have been residing In FL for 2 years.

In Minnesota for misdemeanor violations, the court rules allow you to sign a waiver of appearance and have an attorney appear in your place. Each no appearance can result in another misdemeanor charge of failure to pay or appear, and the no insurance charges are most likely misdemeanors as well.

Assuming these charges are misdemeanors, an attorney should be able to make a deal with the prosecutor where you will be allowed to enter a guilty plea in writing without coming here. They are usually glad to do this to clear their books of old stuff.

It is even possible that a deal could be made where you plea to one ticket and they dismiss the other; that's not a promise, just a possibility.

Chances are that the guilty plea would be reported to the department of motor vehicles in Florida, and this could mess up your Florida driver's license. Best check with the Florida folks in advance as to what will happen to your license. If two guilty pleas mess it up substantially more than one, that might be something I could argue to the prosecutor about why they should drop one in exchange for a plea to the other one.
