Invasion of privacy
If I am in my car and I "flip off" a cop, isn't that my perogative? I was written a disorderly conduct ticket and now must appear in court. It's my car- if I want to pick my nose or scratch my head- I am in the privacy of myself and I should be allowed to do as I please.

You have a constitutional right to "express" yourself under Freedom of Speech. It would be very difficult for a prosecutor to make that charge stick.
