Legal Question in Traffic Law in Minnesota
juvenile
my son was a back seat passenger with two other juvenile males, he was only one charged with posession of paraphenalia and small amount posession marijuana. how can he be only one charged and not the driver or all three of them?

It is up to officer discretion to determine who in the vehicle may or may not have had possession. The decision was likely made based on the location of the paraphrenalia within the vehicle.
