Motor Vehicle laws involving an underage consumption
If a driver(owner) of a motor vehicle goes off the road due to bad road conditions and that driver is 100% sober(passes a breathalizer given by the police officer) is it legal for the police officer to then give the passenger a breathalizer and a underage consumption ticket??

The answer to that is absolutely yes. I can't think of why it would not be legal. For it to not be legal there would have to be some reason why the officer should not have been there. In your question, however, it sounds as if the officer needed to be there.
