off-duty speeding ticket

My eighteen-year-old brother was driving to a friend�s house when

he noticed an SUV driving close behind him. He sped up to try to

create a little distance, but the vehicle followed him into his friend�s

driveway. The driver got out of his vehicle and approached my

brother. It was a city police officer, still in uniform but driving his

private vehicle. He told my brother he had been speeding and

would receive a ticket in the mail. A month later, he got the ticket.

Can an off-duty officer without a radar gun mail a speeding ticket?

The circumstances you describe would lead me to expect that it would not be hard to negotiate a deal which would keep this off his record.

Police officers can issue tickets at any time if they witness an infraction whether on or off duty. If there ws no radar, the officer likely clocked the vehicle. Whether that clocking was accurate is an issue for trial.
