Legal Question in Traffic Law in Minnesota
Police Officer never filed the citation
A police officer stopped my 20 year old son 1 block from home, driving without a license. I know it's wrong, but he has his permit, is a good driver and never goes anywhere but to the store, etc. within a 5-6 block range from home.
This particular officer is known to have a problem with the youth in the neighborhood and is constantly harassing a number of young people, often. Usually for no reason. Anyway...
The office issued my son a citation with a court date that has recently passed (yesterday). I accompanied my son to court, only to find that not only was his case not on the docket, but that the ticket was never filed. The clerk that helped us told us not to worry about it unless we hear from the court in the future. My question is, ''What is the statute of limitations on an unfiled traffic citation?'' Can this come back to haunt us 1-2 years from now? I think the officer just wrote it to frighten my son, but isn't he supposed to file the written ticket?
Thanks....

Re: Police Officer never filed the citation
Your son should count himself lucky. If the ticket isn't filed, there's no way I know it could get on his record.
If you like, it might be a comfort to check his driving record with the state just to make sure. You can do that by calling 651-296-2025.
Don't let him drive alone any more.
