Rear-ending crash

While traveling 40 mph on a two-lane road this morning, a truck pulled out of his driveway onto the road infront of me. I slammed on my brakes and slid (it was somewhat icy) into the truck's left bumper not more than 30-50 feet from his driveway entrance. It was not enough time to stop from hitting the truck. Somehow it's my fault since he was already onto the road. Is there anyway that it would be the truck's fault? There is no damage to his truck, but my bumper is cracked now. Thank you.

If you rearended the truck, there is going to be a presumption that it is your fault. That does not mean, however, that you cannot prove fault. But what you need to consider is that, would a reasonable person know that you wouldn't have been able to stop in time? You should probably talk to a local attorney experienced with car accidents.
