Legal Question in Traffic Law in Minnesota
reckless driving
My brother is 18, his high school's assistant principle saw him driving and did not approve. She said she is considering charging him with reckless driving and calling our parents in. I have two questions, 1. can she charge him with reckless driving even though there is no proof? and no law enforcement authorities on scene or in the general vacinity? 2. Can she contact our parents in a manor like this even though he is a legal adult? shouldn't all things be brought to him now and not anyone else?

Only a prosecutor may file criminal charges. The school official may certainly report the matter to police and, they may pursue charges based on those reports. the case would be weakm,, but could, potentially, proceed.

Yes. There is nothing that would preclude a school official from contacting the parents.
