Legal Question in Wills and Trusts in Minnesota

529 College Fund

My great grandmother left me several thousand dollars in a 529 account in her will. The money was put under my father's name but was only to be used for my college as it said in her will. He recently informed me that he took all the money out of the account and used it to fix his trucks. Is that illegal? Is there any way I can get that money back? If so, how would I go about doing that?

Re: 529 College Fund

It appears that your father illegally used your funds for himself. It may be a crime. You can sue him for the money. You could also report him to the police for fraud and criminal breach of a fiduciary duty.

This is not a good situation. You do have some legal options, but all of them that I can think of will likely cause a severe strain in your relationship with your father.
