Legal Question in Wills and Trusts in Minnesota

Bills are larger than the estate.

My brother recently passed away. He was not married and had no children. He was survived by his mother, sister and myself. He had life insurance with my mother or myself as beneficiary. He rented an appartment and leased a vehicle (not many assets). He did have a small savings and checking account but did owe more to credit cards than what is in the bank. Question: Does the life insurance have to be used to cover the bills? If not how should the assets be divided among all the various credit cards? By percentage of total of the bill?

Re: Bills are larger than the estate.

I doubt the life ins has to be applied. Priority creditors

paid first(funeral, Medical) then general by % this

is very basic and just a very general overview.
