Legal Question in Wills and Trusts in Minnesota
Name Change in a Will
I recently changed my last name to my husbands. We have been married for some time and had drawn up wills before I changed my last name to his. Is it necessry to change our wills to reflect my name change and if so, what should I do and what legal form(s) would I need. Also, what would be the ramifications if the wills were not changed?

Re: Name Change in a Will
Your old will should still be valid; but the name change might require the presentation of some evidence that the person with your previous name is you. It would be best to do a new will. Your husband should probably redo his will too, since his old will probably refers to you by your old name.
Wills are cheap. Have a lawyer do one for you. Get it done right. Those "lawyer approved" do it yourself kits are probably approved by a lawyer from India - or at least Indiana. Have a will done by a lawyer from your own state. It's one of the kindest things you can do for your family.
