Are the children entitled to any part of the estate?
My parents separated in 1983 She moved to Fl. and has lived there since. They never devorced, nor contact. There's 4 Kids. We all live here in MN. We took care of our father. my brother lived in house with father past 3 years. I lived there 33yrs from birth till 2 years ago, I got married. We have always been around my father. Since 1990 when he became disabled, we took even more care of him ect ect ect. My father died Nov 98. at that time, my mother who lived in FL. came to the funeral and said nothing but bad words about him.... (grr). A few weeks ago she came back to MN to fix the house up and sell it claiming "it and everything" there belongs to her. House is paid off, worth 100k+. house was in both name. She last week changed the title over to only hers. She's in process now of evicting my brother from living there and even shut off utilities to get him out. My question is, are us kids entitled to anything? and her being away and abandoning us and living in FL. doesn't that raise a leagal question? I can't understand how she can abandon us and come back after 18 yrs & take everything. If this question hasn't came up in courts, I "WANT" to bring it up now and would like to find the person(s) willing to do it.

if the property was joint with the wife I don't know how to
Force it into probate. You could start an estate as creditors, but if the house was
joint, I don't know how you can get it to be an estate asset. Could they file
a lien on the property or could you put in a claim for child support? .
