Legal Question in Wills and Trusts in Minnesota

controlling big sister

my big sister was the executor of my fathers will, which states to be an equal share between his three children. of which big sister feels she deserves the lion share because she spent more time with him. when in fact she was very cruel to him. another fact is she took over two years to close the estate with no accountability and kept the lions share.

Where was the estate probated? The executor of the estate is, by statute, required to prepare an accounting and give a copy to

the other distributes. If you feel the estate was improperly distributed, you may bring an action in the Probate Court requiring the executor to account for all the estate assets and the fees of the executor can be reviewed. The executor is not supposed to

pay themselves for personal services unless the court authorizes them to do this. You may have to take your sister to court to recover estate assets.
