Legal Question in Wills and Trusts in Minnesota

Is Executor of Will responsible for debt?

I have been named tne executor of my father's will. He does not have any assets to speak of and a lot of debt. At the time of death, am I responsible for this debt? His house was forclosed on and there is a remaining balance of $50K, plus credit card debt and alimony to his ex-wife. Can his creditors come after me for this debt, and if so how am I suppose to pay for it on a limited income?

Re: Is Executor of Will responsible for debt?

You are only responsible if you are appointed by the probate court and accept that appointment.

If there are no assets to probate, then don't probate. Do not get yourself appointed. There is no reason to.

And those creditors can whistle Dixie. If there are no assets for an estate, the creditors get nothing. Too bad.
