Legal Question in Wills and Trusts in Minnesota

My right to see fathers will?

My father just recently passed away, I know he had a will. My ? is... do I have a right to see the will. I have good faith that my father left me something even though my mother says different. I dont understand why she just wont show it to me. What can I do. I'd like some closure to this issue.

Thank you.

Re: My right to see fathers will?

If your mother probates the estate, the will has to be filed with the probate court. It is then a matter of public record and can be viewed by anybody.

If everything is owned jointly, however, there is a chance that the estate will not be probated. In such an event, there would be no property for the will to control because the joint ownership controls.

Good luck. Check with the court if it's probated.
