Legal Question in Wills and Trusts in Minnesota

Finding out about a will

A deceased sibling died and left a will. He had an older will that the sibling in charge wants to file instead and does not want the rest of us to be involved. He died without a spouse or children. Is there a way to be sure he files the new and correct will so the deceased's wishes are followed? We have been told to give him the copies of the new will and stay out of it. Do we have a right to see the will and know what is going on? He died in Minnesota.

Re: Finding out about a will

Since it sounds as if you have a copy of the newer will, I would say you are more or less in fat city. Whatever is filed with the probate court is public. You can go to the courthouse and ask to see the file. If it's the wrong will, file an objection with the court. It's the kind of thing, however, that you should have a lawyer for. I'd be glad to help and can be reached at 952-544-6356.
