Legal Question in Wills and Trusts in Minnesota

How to go about getting information if no will is left?

Our father died on 2/12/99. Our step-mother states there is no will and is having all of his assest put into her name. He informed us before he died that he had two wills that went bad and he wanted us protected. How can we find out assets? Do we need to obtain a lawyer to pursue this for us? What are our legal options?

Re: How to go about getting information if no will is left?

if there is no will, in Minnesota, the second wife is allowed

The first $150,000, plus 1/2 of everything else, and a life estate in the homestead.

A spouse could get the whole estate. What is meant by "he had two wills that went bad"?

His will would still be good even if he remarried after he made the will. They

need to find a copy of the will or wills. Sometimes a special administration is

started just to find assets, etc. Do you know if an estate was started. Call the county where there father lived.
