Legal Question in Wills and Trusts in Minnesota

Living Will

I have a living will, health directive, and a variable power of attorney that was made up for me in Nebraska. Is it good in any state of the union? In other words if I die in Minn. or Ariz. would it still be valid?

Re: Living Will

It depends on a couple of things. It would have to comply with the probate statutes of the state you are now currently living in. Also, if it says anything specifically about Nebraska laws or probating in Nebraska that would affect it as well.

If you want to comply with the laws of the state you are currently living in (Minnesota or Arizona) and the current documents conflict with that state, or they specifically address Nebraska laws, then you might want to consider updating your documents to your current situation.

If you have further questions please let me know.

Thanks
