mom's will

I've been told by my uncle's attorney

that I must get consent from my

mom to get a copy of her will. Is that

correct? This very same attorney told

me last week he would send out copy

and now I get a letter stating he

cannot without consent?What is

going on? My mom is in nursing

home with dimentia. BTW, the

attorney willingly sent my a copy of

my Dad's will without his consent.

I've been trying to get info. from the

attorney ever since my Dad passed

on 10-18-07.

Your question need further information. Is there a conservator or power of attorney for your mother. They can get access to all information and documents. Who is the named executor/personal representative? If you dad passed, is there a probate? If so then there is a probate file with his Will in it. However, since your mother is still alive, only a court appointed conservator or her power of attorney can act for her. Her private documents are hers and not yours. You could petition for the appointment of a conservator for your mother and ask to be appointed. Dennis.
