Legal Question in Wills and Trusts in Minnesota

My mother left the family farm to us - 6 are on the deed.

Her will explicitly states 1 of the children is to be "intentionally omitted from receiving any interest or benefits under this, my Last Will and Testament".

Does that mean those the child excluded from the will will not receive proceeds from the farm sale>

Please accept my condolences on the loss of your mom.

The six people on the deed own the property and when they sell the property, those six people split the proceeds of sale. But there are a few issues which make it impossible to give an exact answer to your question. For example, I'm not sure what actually happened when you say up front "my mother left the family farm to us - 6 are on the deed." How did six people get on the deed in the first place? If six people were on the deed before mom died, then you already have title to the farm, and mom's will has no effect. Or, was mom one of those six people, and she left her 1/6th share through her will? To answer the question, a lawyer would have to have eyes on the deed itself, and mom's will. Sorry I can't give a better answer.

Good luck.
