Tax Refund for mom who passed away

My mom passed away last July.

My Uncle was listed in her will as the Ex. of her estate.

The will stated that her IRA & Life Insurance were to be split between my brother and I.

With her tax refund and the stimulas check..should that also be split and sent to us

My Uncle kept all the money from her bank account when she passed and told us that he was to be refunded for paying for her burial plot...

what state is the probate in is there a will etc you best call an attorney or speak with one at least.
