Legal Question in Wills and Trusts in Minnesota
Un-Contested Asset
My life-partner for 29 years passed away in July of 2003. We kept our relationship extremely private (except to friends and family). There were no mutual wills, listings as beneficiaries, etc. Therefore he died intestate. The estate consisted of no assets to speak of, except for 2002 Toyota Camry.
As I had no standing, his brother, was the executor. The title to the car was held at the time by the finance company & full payment of the loan in case of death was underwritten by an insurance company.
I have had possession of the car since his death in July 2003 (almost 4 years). This was with the full knowledge & approval of the executor (who has always had my current contact information). We had agreed that once the estate was settled he would transfer title to the car to my name.
During the first year after the death we had intermittent phone & mail contact Then he let me know that there were some problems with the insurance company. The executor hates dealing with any paperwork and red tape. Efforts to contact him have proven futile ever since then.
Its been 4 years & I still have the car, parked in a garage, that I cant drive because I don't own it.
What are my options?

It is best to discuss this with an attorney. Feel free to contact me if you have any questions.

File a lien for parking/storage. You may obtain title that way. The DMV has forms.
