Legal Question in Wills and Trusts in Minnesota
No Will, Brother Takes All
My father recently died and his will left everything to my grandmother and step-mother both of whom are also deceased. I haven't even seen the will myself. My older brother has taken everything and claims (CD's and such) were all payable on death to him but I have no way of knowing that this is the case. I live 1000 miles away so I can't run around to banks and stuff asking for info. What can I do? Will the state step in? There is also a younger brother who is just as baffled by the whole thing.

Re: No Will, Brother Takes All
Your father appears to have died intestate leaving all of his estate to the surviving children and to any surviving widow if there is any. Joint accounts would not be part of his estate but would go to the survivor automatically. Any child has the right to file a petition with the court for the intestate administration of your father's estate.
