Legal Question in Wills and Trusts in Minnesota

Last Will

My father's will states that his estate should go to his daughters equally and if a daughter predeased him, it would go to her ''heirs.'' As my sister just passed on, He wants to be sure nothing goes to her husband. I told him ''heirs'' means children and not spouse. Can you please advise if he needs language to be more specific and needs to change his will?

Thank you!

Re: Last Will

Heirs would mean any heirs under that person's will or besed on the intestacy statute if there is no Will. It would include a spouse. THe Will could have been written to indicate that the decedent's share would pass to your sister and, if she predeceased him, to her chidlren. If it did not, the term "heirs" is much more broad.
