Will

My husband passed away recently and our original wills are stored at the lawyers. Our lawyer is no longer in business and can't be found. How can I get the original will so we can process his estate.

I am nowhere near retiring, yet I would like to myself get out of the business of storing wills for my clients.

I have several wills which I am storing in a safe, and I am in the process of trying to contact each client and return those wills. While in my younger days I felt that I would both live and practice law forever, I am no longer so sure about that.

There is a good chance that the will you seek has been deposited at the probate court in the county either where you live or where the lawyer's office was. Probate courts will accept wills for safe keeping. There is a fee of $10 per will. After I am satisfied that some of my clients can't be found, that is probably what I will be doing with those wills I have.

If the original of the will can't be found, there is a process for admitting a true and correct copy into probate, assuming you have a copy of the will. If all else fails, you might have to see what you can do without a will. It is not necessarily a serious problem if there's no will, depending on the circumstances.
