Legal Question in Business Law in Mississippi
I'm being charged by a competitor for violating the Lanham Act. He alleged that I was falsely advertising a product of mine which is in direct competition with one of his products. I admit that I did falsely advertise the product. However, none of my customers ever bought the product in question. I have since taken the product off my shelves. Have I really violated the Lanham Act? Should I be worried?
1 Answer from Attorneys
As a Franchise Attorney I can say this. If you are being charged with Lanham Act violations, you need to consult with a lawyer ASAP. It's not possible to evaluate any claim without investigating all surrounding facts and circumstances. Consult with a trademark or franchise attorney in your area for specific advice.
