Terms of Service Agreement

Hi, I play an online game owned by a large gaming company. I have invested much time in this game, in addition to a monthly fee. I was recently banned from the game and not given any explanation, until I e-mailed the company. I have sent them proof of my innocence but they have blown me off, and they point to thier Terms of Service Agreement and said ''we do have a Terms of Service agreement that covers all aspects of what

The agreement basically claims every right, even taking away the customer's constitutional rights (which isn't legal). Also, when signing up an account, the link to thier Terms of Service Agreement does not work, so I was not able to read the agreement at the time, and most certainly do not agree to the terms.

What are my legal choices in this matter? Are they allowed to protect themselves even if they ban players for no reason? Representatives of the company have said contradictary statments (which I have saved). I basically need some legal jargon to throw thier way so they will take me seriously.

Legal jargon: "This is my last attempt to resolve this amicably. If you do not reply satisfactorily,the next contact will be from my attorney."

Then hire an attorney.
