Legal Question in Criminal Law in Mississippi
Can I appeal a conviction for a misdemeanor that I was convicted of in Mississippi about 8 months ago due to improper conduct of the judge and the prosecutor. The judge was acting as a prosecutor and denied me the right to counsel in court, threatened to have me " tied up in the back " by a bunch of off-duty policemen who were literally hanging out around the judges chair, and then convicted me on a charge of giving false information to an officer that had never identified himself as an officer nor was I ever questioned in custody and the officer admitted that he never identified himself, but that his marked car was enough. This stemmed from an incident where I was pulling out of a dark road at night as him and other officers were reporting to a call my ex-girl friend made about an argument we had had. The officer yelled out of the window " Who are you " as he was pulling into the road and I didn't know who it could be so I answered " Forrest Whittaker ". I drove away without being chased and 5 hours later, he came to my hotel room and without warrant or charges properly filed, pulled me from the room when I stated that I was not coming outside to talk to anyone without a lawyer or charges. I was drunk and didn't want to get arrested for public intoxication. I was jailed after having two other officers point their guns at me. On top of the money, I now have a conviction for something I didn't do and was treated unconstitutionally in an open court. No evidence was presented except the cop's testimony ( which I destroyed ) and a piece of paper that he misspelled his name on and someone else signed for the prosecutor. They had been reading my Facebook posts about the upcoming trial and how according to the Law and police procedures did not break. The police were pointing me out before court even started to the judge and then 3 or 4 officers stood around his chair during my proceedings for the sole purpose of continuing the harassment of me. Recently, the same officers accosted my 16 year old niece at her place of work to tell her to tell me they said, " hello ". I am afraid to visit back home and would like to see justice done so that I can go about my Life without being targeted by police from Home, or other officers when they read my record and decide that I need to be further harassed for lying to a fellow officer. Please help me.

You may file a request to appeal out of time, but it is not required to be granted. You are far past your time for appeal. You are not guaranteed counsel in certain instances. I suggest seeking counsel, but it is most likely far past time to do anything
