Legal Question in Criminal Law in Mississippi
What is considered 'burglary?'
A friend of mine is on probation for a felony drug charge. He got 15 years with 8 years suspended with 7 to serve. He has been released and had been on probation for almost a year. He had a confrontation with an old girlfriend and he left the house and went out of town for a week. She filed an affadavit saying 'he entered her house after he had been forbidden not to'and was charged with burglary. Now he is facing revocation. Would it still be considered burglary if he had lived there and still had a key that she had given him and he only got his things?

Re: What is considered 'burglary?'
Burglary is entering onto property with the intent to commit a crime. Under your facts, this is not burglary.
