Can a person be retried in court for being incarcerated as a drug offender without proof of selling drugs. No evidence was presented in court the first time. Can they appeal the courts decision?

Citizens accused of crime can be tried as many times as it takes to get a verdict. If the accused is found "not guilty," the State can appeal to get a ruling on some disputed area of the case, but the accused is forever "not guilty."
