The question you ask is complicated. The answer depends on the specific crime and whether or not the person subject of the pending Indictment has been arrested before presentation of the case to the Grand Jury or not. If there is an arrest the Miss. Supreme Court has held that the "Speedy Trial rights" time clock is "tolled" thus delay does not cause the State to lose the ability to Indict the Defendant. Some crimes have no statute of limitations thus there is no limit to the time within which the Indictment must be filed.
