Legal Question in Criminal Law in Mississippi

interrogation

If during a police interrogation you request to speak to a lawyer, is it a direct violation of your rights if this request is ignored? Can the police continue to question you and manipulate and scare you into making a statement? How far is too far to go?

Re: interrogation

Yes. Once you request an Attorney the Police have an affirmative duty to cease interrogation. They cannot continue to question you and they are not supposed to try to manipulate or scare you into making any statement whatsoever. In many jurisdictions a statement made following an unsatisfied request for an Attorney can be held inadmissible. Asking a question, the answer to which may incriminate the person, is too far to go once an Attorney has been requested. If this happened to you an Attorney should be consulted at once.
