If a person was and active person when the crime occured does it mean if evidence has came forward that they would be prosicuted in a Military court?

I understand the question to be "if a person was active duty when a crime occurred does it mean if evidence was exposed would the person be prosecuted in a military tribunal?"
The place of prosecution depends not so much on the identity of the culprit as it does on the location of the crime. If the offense occurred on a military installation or on government property it may be prosecuted in Federal Court or in a Court Martial, but if it occurred in the private sector it is most likely the state prosecutor would maintain jurisdiction over the crime and the prosecution for the offense committed.
