Legal Question in Criminal Law in Mississippi
i was recently arrested in mississippi for felony i d theft, for using about $4000 from a deceased individuals bank account to pay some bills. first question, is that i d theft? second question, if so, can i plea to a lesser charge, a misdemenor preferably. any help would be greatly appreciated.

To answer the first question the answer is yes, you have assumed the identity of a person other than yourself for fraudulent purposes thus you violated the law. Your second question cannot be answered so easily. It is doubtful that you will be able to get this charge reduced to a misdemeanor under the circumstances but it is possible with competent counsel and a little luck to be able to arrange a disposition where the Felony does not get recorded on your record and you are able to avoid the disability associated with being a convicted felon. You should contact competent criminal defense counsel at once to discuss your options in this regard.
