Legal Question in Criminal Law in Mississippi
My wife has been convicted and sentenced to 2 sale of a controlled substance(lortab and xanax)
The are trying to charge me with the same charge saying that the Cofidental Informant called me and I set the sale up. If I was not there making the sale and my wife has already been sentenced on those charges, can they still charge me with them?

If you participated in the sale in any manner, you can be charged.

Yes. Setting up the sale is a crime, regardless of whether you were there when the sale occurred. That your wife has already been convicted for her actions does not prevent the state from prosecuting you for yours.
