Wrongly accused of car incident on public street

my car was driven by an out of town driver; and she told me she had an incident in my vehicle 5 days after the incident; my vehicle inwhich she was slowly moving backing up for an eighteen wheeler truck to enter the right lane of a busy three way street; my vehicle and the other driver bumpers contacted with no damages so she continued to sit and wait for the other drivers effort to communicate but instead she pulled into the right lane and passed so the driver of my vehicle proceeded to turn left at the bank parking lot and proceeded towait for the other driver to come around she never did come so she proceeded to pulled up to the bank window and a male appoarch my vehicle getting my tag number and stated you just bumped a womans car then proceeded to run back toward the bank the driver of my vehicle finished her bussiness and proceeded home with my vehicle with no damages what should i do? i donot want to be charged with a hit and run and was not the driver;ps;the vehicle was not insured because it was to be used during the summer vacation of this year fully covered insurance by april of 2004.

It's always good to preserve all evidence as soon as possible if legal action is suspected. One thing to do is have somebody who is not a relative or friend inspect the vehicle for damage and take photographs of the place where the bumper contacted the other car. Also, a letter should be requested in writing from the woman who drove the vehicle. The driver should be asked to describe what happened. Lastly, the police may be contacted to report the vehicle contact and invited to view the absence of damage to the vehicles. As to insurance, operation of motor vehicle without insurance is a misdemeanor with a fine of $1000 which will be reduced to $100 and court costs if proof of insurance is made at the court hearing. Also, the driver's license will be suspended until a year passes or until proof of insurance is made, whichever occurs first. However, the insurance question only arises if the officer had arrived on scene and asked for the insurance card or if the owner or driver volunteers information about the insurance. If the police ask about the car's insurance, the owner or driver can refuse to answer any such questions.

the fact that it was your car is irrelevant. what matters is who did it. you should ask the driver to turn themselves in asap. otherwise, you should provide the identity and location of the driver to the authorities so that they can look in the right direction.
