3rd DUI

Can you tell me if DUI convictions are combined from state to state?

A friend of mine living in Mississippi doing work � originally from Texas and still has his Texas license and tags for his truck � was arrested for DUI the other day. He had one back in �96 or �97 and one in �00, both in Texas and now this one in Mississippi.

So I was wondering if they would combined these so this will be his third or is it separate form state to state? How would it work with him being registered in Texas but living and was pulled over here in Mississippi?

Re: 3rd DUI

All DUI's within the last 5 years will count against him MCA 63-11-30(7). Assuming he has 2 priors, he will be tried as a felon in MS. If convicted, he faces $2-5K fine; 1-5 yr jail; 5 year suspension of driver's license. Also, this conviction will be sent to TX for enforcement.

According to Miss Code Annot (1972) Section 63-11-130, a prior offense outside the State will be counted for purposes of enhancing the potential punishment provided it can be shown that the prior offense was committed within the past five years and the accused was represented by an attorney or declined court-appointe counsel.
