Legal Question in Elder Law in Mississippi
Need advice on what to do regarding mothers death
My mother passed away on 17 April 2006 in Corinth, MS. She was 58 years of age and I am her only child, she has been divorced for nearly 5 years and I have hired an attorney in MS but am not getting the help that I am needing. I have been named administratrix to her estate but have done nothing else besides that. I am not sure what my responsibilities are for the future, regarding her taxes, medical bills and credit card bills. I would really appreciate some advice or where to begin. Thank you.

WOrking with an attorney out of state can be deeply frustrating.I can't see from what you have written that the attorney is or is not doing their job properly - and there are things you can do. You need to marshall the assets of your mother's estate - i.e. figure out what she owned and where it is - and also determine her debts. The sooner you can give the attorney a definitive statement as to what she owned and what she owed, the sooner probate can close. There is also a period of time during which the attorney will likely publish notice of her death, and they have to wait for some months (In WA, four) to be absolutely certain that there are no other creditors expecting to get paid. It just takes a while.
It is difficult for any attorney - especially one across the country - to work for a client who is convinced they are "doing nothing". Be proactive. Make sure you have provided all the information requested and all the relevant information. Make sure you are reachable by phone and mail.
If you are doing this all ready and the notice to creditors period has run, and nothing is happening, you want to communicate in writing with your attorney and make sure they know you think this is taking too long. There may be some perfectly valid reason, or it may be that there is no good reason.
Please accept my sympathy on your loss of your mother.
