Agreed Petition for Custody

My child is 16 and wants to come live with me but I do not want to go through a lawyer. I have been told the first thing is to send a petition for custody. I would like to do this on my own but need a form or something to go by. Both parents are in agreement.

That's the rub. You don't want to go through a lawyer, but you don't know what to do. Other than ask for free legal advice from lawyers. It isn't that you don't want to use a lawyer, it's that you don't want to pay a lawyer.

A modification of divorce is done by a motion to modify and an order from the court. Mississippi does not have forms for such action, but you might obtain a sample of a previous one from the chancery clerk. It is probable that following the sample, and submitting the judgment to the chancellor two or three times will get you what you want because they have an interest in making sure the judgment is enforceable and fair, and they are tolerant of pro se litigants.
