Birth Certificate changes

My daughter was born in the state of Mississippi and the named father on her birth cert is not her biological father (proven by blood test) I would like to know what steps I need to take being a TExas resident to have his name removed and have her biological father's name added to her birth certificate.

Hello there --

For a Court to change the name of a child, you could institute a suit for change of name of child or a suit affecting the parent-child relationship. The first option sounds simple enough, and could be used to effectively remove the child's last name and change it to yours or another name. A Court, however, would likely not authorize the change to an alleged father's last name without a Court determination that the alleged father is, in fact, the biological father. This brings us to the second option. In the Suit Affecting Parent-Child Relationship, you would seek to prove paternity by DNA testing, and then the Court would enter an order determining support obligations, custody, and so forth. As a part of that order, the child's name could be changed to reflect that of the biological father.

Initiate a paternity action in Texas with the help of a lawyer and make the Miss. Dept of Vital Statistics a named defendant.
