Legal Question in Family Law in Mississippi
bribing parent
Mother ask us to take baby and adopt. Father (my nephew)hasn't seen child in months. Says he wants to get baby. Hasn't called, seen or bought baby anything. Baby stays with us 4 to 5 days a week. How can we legally bribe my nephew into letting us adopt. He also has another baby on the way with another girl. The mother would if father would. The father's name is not on the birth certificate and he doesn't pay child support. Welfare knows he's the father, they did a blood test. What, if anything can we do to get the baby? We have taken care of him for 9 months like this.

Re: bribing parent
Sorry, can't pay a parent for a child. You will have to file suit seeking adoption and termination of parental rights, and in the alternative, termination of the mother's parental rights, guardianship for you, and child support from the father. The father's lack of support and nurture for the child are proof of abandonment. However, since this is your nephew we are talking about, it would be best to seek the help of a mediator before a suit is filed. The mediator can help the father realize that adoption may be in the child's best interest and that he may still be able to work with you in helping the child have the best upbringing possible under the circumstances. Also, you should not delay action very long. The first child to seek child support gets a bigger portion of the available child support.
